1. Acceptance of Terms

Welcome to PopcornAI.art ("we," "us," "our," or the "PopcornAI Team"). By accessing or using our website and AI generation services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms").

Please read these Terms carefully. If you do not agree to these Terms, you must not access or use our Services.

2. Eligibility

The Services are intended solely for users who are 18 years of age or older. By accessing or using the Services, you represent and warrant that you are at least 18 years old. If you are using the Services on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.

3. Accounts and Security

To access certain features (such as generating videos or purchasing credits), you must register for an account. You agree to:

  • Provide accurate and current information.
  • Keep your login credentials secure.
  • Accept responsibility for all activities that occur under your account.

We reserve the right to disable any user account at any time if, in our reasonable opinion, you have failed to comply with any of the provisions of these Terms.

4. User Content and Permissions

4.1 Ownership

You retain all ownership rights to the text prompts, images, and videos you upload or generate using PopcornAI ("User Content"). We do not claim ownership of your content.

4.2 Commercial Use

  • Subscribers: Users with an active paid subscription are granted a perpetual license to use the content they generate for commercial purposes.
  • Free Users: Unless otherwise stated on the specific plan description, content generated by free users is for personal, non-commercial use only.

4.3 License to PopcornAI (Visibility Settings)

Our platform offers different visibility settings which affect how you license your content to us:

  • Default Public Mode: By default, your generated videos and prompts may be visible to the public (e.g., in the "Explore" feed). By using the Service in this mode, you grant PopcornAI a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, modify, display, and distribute your User Content for the purposes of operating, promoting, and improving our Services (including model training).
  • Copyright Protection Mode (Private): If you enable the "Copyright Protection" option (or "Private Mode") in your settings, your uploads and generated content will be hidden from the community. In this case, you grant us a limited license solely to process, store, and display the content to you for the purpose of providing the Service. We will not display such private content in the public "Explore" feed.

4.4 Content Restrictions

You are strictly prohibited from using the Service to generate, upload, or share content that:

  • Is illegal, violent, or promotes terrorism.
  • Contains NSFW (Not Safe For Work) material, including explicit sexual content or pornography.
  • Infringes upon the intellectual property or privacy rights of others.
  • Engages in unauthorized "deepfakes" or impersonates real persons without consent.
  • Contains hate speech, harassment, or defamation.

We reserve the right to remove any content that violates these restrictions and suspend your account without refund.

5. Credits, Subscriptions, and Payments

5.1 Subscription Plans

We offer subscription plans that provide a monthly allowance of credits.

  • Billing Cycle: Subscription fees are billed in advance on a recurring basis (monthly or annually).
  • Cancellation: You may cancel your subscription at any time through your account settings. Your benefits will continue until the end of the current billing period. We do not provide refunds for partial subscription periods.

5.2 Credits (Token System)

  • Monthly Credits: Credits included in your subscription plan may reset at the beginning of each billing cycle. Unused monthly credits do not roll over unless specified in your plan details.
  • Top-up Credits: You may purchase additional credit packs ("Pay-as-you-go"). These credits are added to your account balance immediately.

5.3 Refund Policy

All purchases (Subscriptions and Credit Packs) are final and non-refundable. Exceptions are made only in the case of a verifiable technical error on our part that prevents the delivery of the Service (e.g., system failure resulting in non-delivery of credits). Dissatisfaction with the artistic style or quality of the AI-generated output does not constitute grounds for a refund, as AI generation is inherently probabilistic.

6. Intellectual Property Rights

The Service itself, including its architecture, visual interfaces, software, code, and "PopcornAI" branding, is the property of the PopcornAI Team and is protected by copyright and intellectual property laws. You agree not to reverse engineer, decompile, or attempt to extract the source code of the Service.

7. Disclaimers and Limitation of Liability

7.1 "As Is" Service

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties regarding the quality, accuracy, or reliability of the AI-generated content. You acknowledge that AI services may occasionally produce artifacts, errors, or unexpected results.

7.2 Limitation of Liability

To the maximum extent permitted by law, the PopcornAI Team shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Service;
  • Any conduct or content of any third party on the Service;
  • Any content obtained from the Service.

8. Changes to Terms

We may modify these Terms at any time. If we make material changes, we will provide notice through the Service or by other means. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the PopcornAI Team is established, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved through amicable negotiation.
